GENERAL PROVISIONS
These General Terms and Conditions of Use of the CorvusPay service for private persons [hereinafter: “General Terms and Conditions”] regulate all rights and obligations of the company CORVUS PAY d.o.o., Zagreb, Buzinski prilaz 10, PIN 67770246314 [hereinafter: “Corvus”] and the rights and obligations of the User regarding the use of the CorvusPay service for private persons [hereinafter: “Service”].
The basic prerequisite for using the Service is the successful registration of the User, which, in addition to completing the registration form, includes acceptance of these General Terms and Conditions and the Personal Data Protection Policy. Upon completion of the abovementioned actions, the agreement on the use of the Service between Corvus and the User shall be considered concluded.
If the User does not meet the conditions for use of the Service or does not agree with any provision of these General Terms and Conditions or the Privacy Policy, or is under 18 years of age, the User shall refrain from registering and using the Service.
By using the Service, the User confirms that they have read and understood these General Terms and Conditions and the Privacy Policy and that they fully accept the rights and obligations stated therein.
- DEFINITION OF TERMS
Certain terms contained in these Terms and Conditions shall have the following meanings:
3D secure – a global Cardholder authentication standard developed to enable each User to confirm authenticity with regard to their Card Issuer when making an online purchase, thereby confirming that they are personally involved in the online purchase and payment process.
Primary Account Number – the number that identifies the Issuer [first 6 digits] and the User’s unique account [remaining digits], designated by the acronym PAN.
IBAN – transactional account number of the Account Holder.
Corvus Wallet – functionality of the Service that provides the possibility of electronic storage of Personal and Card Data of the User, except the Card Validation Code, in accordance with the User data protection standard in the payment card industry – PCI DSS, and usage of said data to make payments at the request of the User. The Corvus wallet is available through the CorvusPay web and the CorvusPay mobile app.
CorvusPay web app – web application at https://wallet.corvuspay.com supported on browsers: Internet Explorer 9+, Chrome, Firefox, Safari.
Corvus Pay mobile App – mobile application for users of Android and iOS operating systems available on the Google Play Store and App Store.
CorvusPay by IBAN – a payment initiation service that enables the payee to have their payer [Account Holder] initiate payment to the payee’s account from their account opened with the payment service provider that maintains the Account Holder’s account in order to purchase goods or services at its Electronic Point of Sale.
Payment Initiation – a service of placing a payment order at the request of a payment service user [Account Holder] from their account maintained by another payment service provider.
Payment Service Provider maintaining the account of the Account Holder – a payment service provider that opens and maintains an account for the Account Holder and towards which Corvus initiated the payment of the Account Holder.
Electronic Point of Sale – a point of sale of the Merchant connected to the Internet where the Trader offers the sale of goods or services online with the possibility of payment by Payment Cards or via the CorvusPay by IBAN service.
Electronic Point of Sale with Quick Purchase – Electronic Point of Sale through which the User, by selecting the Corvus Wallet payment option or by scanning the QR code with the CorvusPay mobile app , may log into the Service using credentials of that Electronic Point of Sale.
Issuer – a payment service provider that issued a Payment Card to the User, which is used to initiate Transactions.
Card Payment Scheme – business operators that manage international payment schemes including, but not limited to: Mastercard International, Visa International.
Card Information – Primary Account Number, Payment Card Expiration Date, Card Validation Code and Name and Surname of the Cardholder.
Card Validation Code – three-digit or four-digit number printed on the Payment Card which serves as proof that the User physically owns the Payment Card at the moment of purchase. Depending on the Card Payment Scheme, the Card Validation Code is usually denoted by acronyms CVV, CVV2, CVC2, CSC or CID.
Cardholder – the person whose name is printed on the Payment Card.
Account Holder – within the meaning of these General Terms and Conditions, a natural person who has a payment account and executes an order for payment from said account.
User – any natural person who has accepted these General Terms and Conditions and the Personal Data Protection Policy in the registration process regarding the Service and who is a Cardholder or Account Holder.
Masked Primary Account Number – a display of the first 6 and last 4 digits of the Primary Account Number.
Online Authorization – approval of the Payment Card Issuer for the payment of the requested amount in the form of an alphanumeric string.
Authentication – verification of the identity of the Account Holder by the payment service provider maintaining their account during the payment initiation process. The authentication method is determined by the payment service provider maintaining the account.
Personal Data – name, surname, e-mail, mobile phone number, address, postal code, city, country, IBAN and Card information.
PCI DSS – a comprehensive set of standards for maintaining data security in card payments developed by Card Payment Schemes. The Management Board of the PCI Council consists of founders such as Visa Inc., Mastercard Worldwide and American Express.
Payment Card – a payment instrument that enables the User to make payments for goods and services either via a POS terminal or online. The Service supports the following Payment Cards: Visa, Mastercard, Maestro, American Express and Diners.
Acquirer – a payment service provider that ensures the Merchant’s acceptance of the Payment Card and processing of the Transaction, which results in the transfer of monies to the Merchant.
Transaction – payment for purchased goods or services by Payment Card or IBAN at the Merchant’s Electronic Point of Sale, which, in the case of payment by Payment Card, is processed through the card infrastructure and according to the rules of the Card Payment Scheme, and, in case of payment by IBAN, through the Payment Service Provider maintaining the account of the Account Holder.
Merchant – A company or sole proprietorship with an integrated Corvus Wallet payment option for billing goods and/or services at an Electronic Point of Sale connected the Internet, i.e. a web-store, and has concluded an agreement for the provision of Internet transaction processing services with Corvus, a payment card acceptance agreement with the Acquirer or an agreement to initiate payment services at points of sale.
- CREATING A USER ACCOUNT
The User account for the Service is created by filling in the registration form on the CorvusPay mobile App or Corvus Pay web App , where the User enters and stores the following data: name, surname, e-mail, mobile phone number, address, postal code, city, country. After filling in the registration form, the User may save one or more Payment Cards by entering the following data: name, surname, Primary Account Number, Payment Card Expiration Date and Card Validation Code provided that he is also the Cardholder. By storing one or more Payment Cards, the User provides consent to Corvus for sending, at the User’s request, future requests for authorization of the Payment Card to the Acquirer in order to obtain the funds necessary for the realization of a particular Transaction. When saving the Payment Card, Corvus verifies the validity of the Payment Card by creating an online authorization for 1 kuna. After the Issuer approves the online authorization, the online authorization is automatically cancelled and is not charged to the Payment Card. Payment Cards that do not participate in the 3D Secure program cannot be added to the CorvusPay web or Mobile App providing the Service.
In case the Payment card is stored in Corvus Wallet at the Electronic Point of Sale with quick purchase by selecting the option “Save card for faster payments”, Corvus validates the Payment Card by processing Transactions intended for payment of goods / services at the Merchant’s electronic point of sale.
In the case of Payment Cards participating in the 3D secure program, the User will be redirected to additional authentication to the URL of the Card Issuer, where they will be required to enter data to confirm their identity using a token or password. A Payment Card that has not been successfully verified by 3D secure program cannot be stored in the CorvusPay web or Mobile App providing the Service.
The exchange of the aforementioned data is performed securely and solely between the User and the Card Issuer.
In addition to storing Payment Cards, the User may store one or more IBAN accounts in the CorvusPay web or Mobile App providing the Service by selecting the Payment Service Provider maintaining the account of the Account Holder [Bank] and entering the IBAN account opened with that Provider, provided that the User is the account holder or authorized to use this account.
The account is personal, unique and non-transferable. Each User may only hold one User Account.
By selecting the option “ Save card for faster payments” during the payment process for goods/services purchased at the Electronic Point of Sale with Quick Purchase, the User may store the entered Personal and Card Data and an account, which is inactive, will be opened for them for the purpose of using the Service. Corvus will send a notification to the User to the entered e-mail address with an explanation of the steps for activating the User Account. The User Account will be activated upon accepting these General Terms of Use and the Privacy Policy by clicking on the link provided in the notification. A temporary password is automatically created for the inactive user account. Corvus suggests that the User should change the password after activating the User Account.
- USER ACCOUNT PROTECTION AND ACCOUNT UPDATING
Upon each login to the CorvusPay web or Mobile App providing the Service, the User enters their credentials [username, password] which serve to authenticate access to the Service, and which they are obligated to store in a secure manner or so that they are inaccessible to unauthorized persons. In addition to credentials, the User may log in to the CorvusPay Mobile App using biometric data (fingerprint or face recognition) or by entering access code. The User shall be personally responsible for all activities performed under their credentials, including the activities of other persons [whether or not the User authorized them to undertake these activities]. Corvus shall not be liable on any grounds and for any damage that may occur to the User and/or third parties as a result of acting contrary to these provisions or improper handling of the User credentials or misuse or unauthorized use thereof.
If the User becomes aware of unauthorized access or unauthorized use of the User Account, they are obligated to immediately notify the Issuer and Corvus by e-mail at: buyer.support@corvuspay.com and be sure to provide all the information necessary to assess the veracity of the claim.
Corvus reserves the right to demand that the User change their password.
The User is obligated to enter the data necessary for the use of the Service accurately and completely. The User shall be responsible for and warrant that the information provided to Corvus in connection with the registration of the Service is accurate, true and complete and that they will keep them as such. Corvus shall not be responsible for the accuracy, truthfulness or completeness of the payment information transmitted on behalf of the User. The User is obligated to immediately notify Corvus of any changes to any information entered during the registration process or at any other time during the use of the Service.
Corvus reserves the discretion to, without the need to justify its decision, reject the User’s request to register for the Service for any reason or for no reason, and, in this case, Corvus shall not be liable for any damages or any other type of direct or indirect loss that would thereby be incurred by the User.
- USING THE SERVICE
The User creates an order at the Electronic Point of Sale of the Merchant, where they are subject to the terms and conditions of the specified Electronic Point of Sale. After the User selects payment via the Service and performs the authentication, Corvus, in the case where the User selects a Payment Card as means of payment, sends the data necessary for the payment to the Acquirer, and, in the case of selecting payment by IBAN, performs Initiation of Payment through the Payment Service Provider maintaining the account of the Account Holder. Should the Acquirer so request, the User undertakes to enter the Card Validation Code upon ordering. Corvus does not store the Card Validation Code , but only transmits it to the Acquirer. The User is obligated to use the Payment Card in accordance with the general terms and conditions of the Issuer, and the IBAN in accordance with the general terms and conditions of the Payment Service Provider maintaining the account of the Account Holder.
The User shall be liable for any costs or charges to the Payment Card or IBAN incurred as a result of Transactions performed using payment data through the Service and any fees that the Card Issuer or Payment Service Provider maintaining the account of the Account Holder may charge in connection with these Transactions. The User is also obligated to settle any tax liabilities that may arise as a result of the Transaction.
Corvus is neither the Card Issuer nor the Payment Service Provider maintaining the account of the Account Holder. Corvus does not guarantee the validity of the Payment Card, the validity of the IBAN or the Authorization of the transaction. The Card Issuer or the Payment Service Provider maintaining the account of the Account Holder shall be responsible for the aforementioned elements. For all questions or problems related to the Payment Card or IBAN, the User is referred to the Issuer or Payment Service Provider maintaining the account of the Account Holder. All terms and conditions of purchase of products or services, including the description of products or services offered by the Merchant, are subject to the special terms and conditions of that Merchant and exclusively refer to the contractual relationship between the User and the Merchant. With regard all questions or issues related to the Transaction carried out through the Service, the User must contact the Merchant with whom they have contracted that Transaction.
Corvus does not guarantee that all Transactions will be completed or that the Issuer or the Payment Service Provider maintaining the account of the Account Holder will authorize the Transactions initiated by the User. Corvus in no way controls the execution of Transactions but only, at the request of the User, transfers the User’s payment data via the Service to the Acquirer or the Payment Service Provider maintaining the account of the Account Holder.
Corvus is authorized to suspend, change or modify the Service at any time. The resulting changes may require updating User data in order to enable further use of the Service. Corvus shall not have any responsibility or obligation to the User with respect to any interruption, modification or change related to the Service.
- LICENSE
Corvus shall grant the User a limited, non-exclusive and non-transferable right to use the CorvusPay web or Mobile App providing the Service, subject to the terms of these General Terms and Conditions, solely for the purpose of storing Personal and Card Data and transferring payment data to Merchants.
The use of the CorvusPay web or Mobile App providing the Service shall not grant any rights or licenses except for limited use as set forth in these General Terms and Conditions.
The User declares that they will not, either directly or indirectly, partially or completely, modify the CorvusPay web or Mobile App providing the Service, reverse engineer, copy, distribute or create derivatives based on the CorvusPay web or Mobile App providing the Service, and, in case of violation of these provision, Corvus shall be authorized to prevent the User from using the Service.
The User is not allowed to:
- use the Service for purposes other than those for which it is expressly intended;
- use the Service in connection with deceptive or illegal conduct, transaction or business, which Corvus shall determine at its sole discretion;
- register on the Service by an automated procedure or with false or criminal intentions;
- interfere with, circumvent or alter any security mechanism used by Corvus;
- use or run any automated system, including a robot, Web crawler or offline reader to access the Service;
- store Payment Cards or IBAN that do not bear their name;
- rent, lend, trade, sell, resell or in any other way charge another person for access to the Service;
- transmit viruses, worms, malfunctions, Trojans, or any other programme of a destructive nature;
- try to perform any of the aforementioned acts, or assist or allow any person to engage in any of said acts.
- OWNERSHIP AND RIGHTS
Corvus owns and reserves all rights regarding the Service, including intellectual property rights. Corvus owns and reserves all rights to all names, trademarks, slogans, logos, domain names and other marks of Corvus or the Service. The User is not allowed to use the stated intellectual property in any way without obtaining prior written permission of Corvus. Corvus reserves all rights not expressly granted otherwise in these Terms and Conditions.
7. THIRD PARTY SITES
The Service may contain links to third-party websites or to the content of those sites. Third-party websites are not under the control of Corvus and Corvus shall not be responsible or guarantee for their content. Moreover, Corvus shall not be responsible for the security, operation or use of any third-party website, product or service that may be offered or obtained through them, nor for the accuracy, completeness or reliability of any information obtained through the third-party website. By clicking on a link or pop-up of a third-party website, the User leaves the services controlled by Corvus and all personal data that the User may enter after leaving the Service are subject to the privacy policies of said third party. The User shall be responsible for reviewing these rules before entering their personal information and the User is hereby warned to provide this information at their own risk. The User shall expressly waive making any claims against Corvus in relation to any damage, loss or any other liability arising as a result of accessing or using any third-party sites.
- CONNECTING CREDENTIALS WITH THIRD PARTIES
The User may, associate their credentials with a third party that provides services unrelated to the services provided by Corvus. By linking their identifier with a third party, the User will be able to access their User account for the Services using a third-party identifier. The User may connect to a third party only if they have already created a credentials for the Service.
The process of associating an identifier with a third party is conducted as follows:
- Within the User Account, under “My profile / Connecting to third-party accounts”, the User may connect their profile with the selected third party by selecting “Connect”. In order for the User to connect their profile to a third party, they must enter the correct username and password to log in to the third party. The User can subsequently terminate the connection between the credentials and the third party at any time by selecting “Cancel” under “My profile / Connecting to third-party accounts”
The process of logging in through a third party is conducted as follows:
- The User may select the icon of the third party with which they previously connected their credentials on the login screen of the Service. A User who has a connected to a third party will be able to log in to their account automatically by clicking on the third party icon, provided they are logged in with the third party at that moment. If the User is not logged in with the third party to which they have connected their account, the User will log in to their account by entering the username and password of the third party.
- CONNECTING CREDENTIALS WITH MERCHANT ACCOUNTS
The User may, through the CorvusPay web App providing the Service, associate their credentials with the user accounts of Merchants which have integrated their Electronic Point of Sale with Corvus with Quick Purchase. By connecting their credentials with the Merchant’s user account, the User will be able to access their User Account for Services using the Merchant’s credentials when paying at the Electronic Point of Sale with Quick Purchase or at the site of the Merchant with which they previously connected their credentials.
The process of connecting the credentials with the Merchant’s user account is conducted as follows:
- Within the User Account, under “My profile / Connecting Corvus Wallet to Merchant accounts”, the User may connect their profile with a Merchant’s user account by selecting “Connect”. In order for the User to connect their profile to a Merchant’s user account, they must enter the correct username and password to log in to a Merchant’s user account. The User can subsequently terminate the connection between the credentials and the Merchant’s user account at any time by selecting “Cancel” under “My profile / Connecting Corvus Wallet to Merchant accounts”.
- The User may associate their credentials with an existing Merchant user account and during the process of payment for goods at the Electronic Point of Sale with Quick Purchase by selecting the Corvus Wallet payment option and the option “Connect Corvus Wallet to Merchant User Account”.
- By selecting the “ Save card for faster payments ” option [during the process of paying for goods purchased at an Electronic Point of Sale with Quick Purchase] and activating the Corvus Wallet User Account, it will automatically connect to the Electronic Point of Sale with Quick Purchase.
The process of logging in with the Merchant’s account is conducted as follows:
- When using the Corvus Wallet payment option at the Electronic Point of Sale with Quick Purchase or payment with CorvusPay mobile app, the User automatically logs into their account for the purpose of conducting the payment process using stored Payment Cards or IBANs. The prerequisite for automatic login to the User Account for the Service is the prior association of credentials with the Merchant’s user account.
- INDEMNIFICATION
The User agrees to indemnify and relieve Corvus and its employees of and against all claims, liabilities, damages [actual and consequential], losses, fines and costs [including legal and other fees and investigation costs] arising out of or in any way connected with:
- using the Service by the User for purposes for which it is not intended;
- violation of these General Terms and Conditions or applicable laws by the User;
- negligence or intent of the User;
- any dispute between the User and a third party, including any Merchant or financial institution or
- the User’s infringement of any third-party rights, including intellectual property rights.
- DISCLAIMER OF GUARANTEE FOR USE
Corvus does not guarantee that the Service is error-free and allows it to be used in its final form, on an “as is” basis and with all errors, and these General Terms and Conditions exclude any guarantee regarding any defects thereof. Although Corvus constantly tests the Service and their maintenance, Corvus does not guarantee that there will be no errors in their operation when using the Service. Considering the previous statement, Corvus makes no guarantees other than those expressly stated, and, in particular, no guarantees of satisfactory quality, fitness for a particular purpose, reliability or availability, accuracy or completeness of the Service, nor the absence of viruses.
Corvus does not warrant that the information contained in the Service is accurate or complete or that the Corvus site will be error-free, without interruptions, free of spyware, malware, adware, viruses, worms or any other malicious code or that it will function as expected. Corvus does not warrant that the Service will run on the User’s hardware or operating system or any other software installed on the User’s computer or mobile phone. The User shall assume all risks associated with the use of the Service and be solely authorized and responsible for determining whether it is appropriate and suitable for their needs.
- LIMITATION OF LIABILITY
The liability of Corvus towards the User shall in all circumstances be limited to the actual amount of direct pecuniary damage.
To the extent applicable by law, Corvus shall not be liable to the User or third parties and the User undertakes not to hold it liable for any damage or loss incurred directly or indirectly due to or in connection with:
- these General Terms and Conditions;
- using the Service, particularly in connection with the use of the Service in combination with third-party apps;
- the inability to use the Service due to improper actions of the User;
- unavailability or delay of the Service as a result of technical issues or force majeure;
- errors in the operation of the Service;
- omissions, errors or inaccuracies of any kind on the Service;
- inadequacies of the Service with regard to the needs of the User;
- by any action or inaction by the Merchant;
- using a mobile phone;
- third-party websites;
- conducting the Transaction using the data specified in the User Profile;
- products or services procured through a Transaction conducted via the CorvusPay web or Mobile App providing the Service using the User’s payment information;
- User’s Payment Card or IBAN;
- discretionary decision of Corvus on suspension of operation, i.e. use and access to the Service itself in relation to an individual User;
- spyware, malware, adware, viruses, worms or other malicious programs accessed using the CorvusPay web or Mobile App providing the Service;
- the consequences of failing to update the CorvusPay web or Mobile App providing the Service or the operating system on the User’s device;
- shutdowns or interferences in telecommunication channels;
- fulfilling legal obligations.
Corvus shall not be liable to the User for damages if, despite appropriate and reasonable safeguards, any loss or destruction, unauthorized access, unauthorized alteration, unauthorized publication or any other misuse of data occurs, especially when these circumstances are caused by force majeure, mishandling, influence of others licensed and unlicensed computer programmes, viruses and other harmful influences.
- FORCE MAJEURE
Corvus shall be free of liability for any error, unavailability, or delay arising from external, extraordinary, and unforeseeable circumstances beyond its control which could not have been prevented, remedied, or avoided, and which include, but are not limited to fires, earthquakes, floods or other natural disasters, government acts, legislative restrictions, operating conditions, delays or failures caused by problems in other systems or the network, mechanical error or data processing errors.
- NOTIFICATIONS AND NOTICES, COMPLAINTS
Corvus may provide Customer with information and notices regarding new products and services, development of existing products and services, and account information. Corvus will use the User’s e-mail to communicate with the User. It is the user’s responsibility to take care of the accuracy of the data, check the e-mail and will ensure its correct operation. In the event that the User does not comply with the above and consequently does not receive the e-mail or receives it late, this shall be considered a failure on the part of the User, and Corvus shall not be liable for damages resulting therefrom. The user is obligated to take all reasonable measures to ensure the security of their e-mail address. The user is obligated to ensure that only they have access to their e-mail address.
The User is obligated to notify Corvus without delay by e-mail at buyer.support@corvuspay.com if the security of the User’s e-mail address is compromised.
Corvus shall not be liable for damages resulting from the User’s actions to the contrary.
Corvus may, with the prior consent of potential Users, periodically send news and offers to the e-mail address provided by the respondent as a potential User to Corvus to send newsletters or other information about Corvus news and products and services. In addition, Corvus may send notifications to existing Users about news, products, improvements to existing products, etc. to the User based on a legitimate interest. If the potential User has decided that he no longer wishes to receive the mentioned newsletters, he can unsubscribe by unsubscribing which will be at the bottom of the received newsletter.
Also, existing Users whose e-mail data is processed for the purpose of sending notifications or newsletters based on legitimate interest may unsubscribe from the e-mail they receive the notification and consequently will no longer receive the newsletter, news notifications or Corvus offers.
If the User considers that their right has been violated while using the Service, they may send a written complaint:
- to the business address of CORVUS PAY d.o.o., Zagreb, Buzinski prilaz 10;
- to the e-mail address info@corvuspay.com
Corvus shall determine the body competent to deal with the complaint and its authority.
The complaint should contain a detailed description of the event or situation, and, if possible, evidence on which the complaint is based. In the event that the User does not provide a description of the event/situation, or if the evidence is incomplete, Corvus shall be authorized to ask the User to complete their complaint, and Corvus will not be liable for any harmful consequences that may arise due to an incomplete complaint of the User.
Corvus shall respond to the User’s complaint within a reasonable period.
- CHANGES TO THE GENERAL TERMS AND CONDITIONS
Use of the Service shall be free. In the future, Corvus may start charging for the use of the Service or its certain additional features or functionalities at any time, at its own discretion, and undertakes to notify the User in advance thereof. Corvus may, from time to time, change these General Terms and Conditions or provide other information regarding the Service at any time by posting it on the website or by sending an e-mail to the User’s e-mail address. It shall be considered that the User has received all announcements and notifications within 3 working days after Corvus has published or sent them by e-mail. If the User does not accept changes to these Terms and Conditions or other information or notices, they are obligated to stop using the Service and disable their User Account. It is considered that the User has accepted all changes or other information or notifications if they have continued to use the Service after the expiration of the aforementioned period of 3 working days.
- DURATION, TERMINATION OF USE
These General Terms and Conditions shall enter into force upon their acceptance at the moment of registration and remain in force, with all their amendments, for the entire period of use of the Service by the User.
Corvus reserves the discretion to temporarily or permanently restrict or terminate the use of and access to the Service or access to or use of any payment information stored within the CorvusPay web or Mobile App providing the Service at any time, for any reason or with no reason, without prior notice, in the following cases:
- if the User acts in opposition to the provisions of these General Terms and Conditions or any related document;
- if required by law or an authorized state or other authority;
- if the User has not updated their contact details or does not respond to the warnings sent to them by Corvus;
- where, according to Corvus, there may be risks to Corvus’ business operations;
- if the User has stated information that is false, inaccurate or incomplete in the CorvusPay web or Mobile App providing the Service;
- if Corvus determines or suspects the User to be participating in fraud or other illegal or immoral activities;
- if the User has not activated the Service for more than 24 [twenty-four] months.
The User may terminate these General Terms and Conditions at will and without good reason by terminating the use of the Service or deactivating it.
Upon termination of these General Terms and Conditions for any reason, the rights and licenses guaranteed to the User will be terminated with immediate effect and the User is obliged to immediately stop using the Service. The Terms and Warranties contained in these General Terms and Conditions, which by their nature and context are intended to last and will continue to be effective upon termination of these Terms.
Corvus shall not be liable for any damages or any other type of direct or indirect loss or other possible claims arising out of the termination of these Terms and Conditions, the inability to access and/or suspension of the use of the Service in whole or in part.
- APPLICABLE LAW, SETTLEMENT OF DISPUTES
The law of the Republic of Croatia shall apply to these General Terms and Conditions and to mutual rights and obligations, with the exception of conflict-of-laws rules that would refer to the law of another country.
All disputes arising out of or in connection with these General Terms and Conditions and/or the professional relationship between Corvus and the User shall be settled before the court with actual jurisdiction at the seat of Corvus, unless another court or competent authority should hold exclusive jurisdiction thereof.
- PARTIAL INVALIDITY
If at any time one or more provisions [or any part thereof] of the General Terms and Conditions should for any reason become invalid, unenforceable or void in any respect, that fact shall have no effect on the other provisions of these General Terms and Conditions. Such a provision shall be replaced by a new, valid and enforceable provision which shall, to the greatest extent possible, enable the objective intended to be achieved by the provision which has been found to be invalid, unenforceable or null and void.
- TRANSFER OF RIGHTS AND OBLIGATIONS
The User shall not be authorised to transfer the rights and obligations from these General Terms and Conditions to any other natural or legal person.
- ENTRY INTO FORCE
The provisions of the General Terms and Conditions shall enter into force and apply from 28.03.2022, and shall be available on the CorvusPay web or Mobile App providing the Service and on the website https://wallet.corvuspay.com/.
